TERMS & CONDITIONS

These Terms govern your access to, usage of all content, Product and Services available at 8ballimaging.com website (the “Service”) operated by 8 Ball Imaging, LLP (“us”, “we”, or “our”).
Your access to our services are subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.
Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Shipping

A. Carriers: Customers have the option to ship their order via the United States Postal Service (USPS), UPS Ground or Federal Express (FedEx).

  • USPS: Priority Mail and Express are the only shipping options available from the United States Post Office. Transit times posted to a customer’s order for Priority Mail are provided by USPS as estimated times and are not guaranteed. The Post Office reserves up to 15 days from time of shipment to complete the delivery per USPS policy. For Express, USPS guarantees a 1 or 2 day delivery by 3:00 PM 365 days a year in many locations.
  • UPS Ground/FedEx: Ground, Standard Overnight & One-Rate 2-Day are available upon checkout. Please note that transit times for FedEx Ground are not guaranteed and are only estimates. For guaranteed time of delivery, please use one of our expedited FedEx options—Overnight or One-Rate 2-Day Envelope or Box (if available).
  • Shippable orders will receive via email a tracking number corresponding to the recipient’s selected carrier. Orders consisting of multiple packages may have separate tracking numbers. Selected shipping methods cannot be changed while a package is in transit nor can a package be redirected once it has left our facility.
  • 8 Ball Imaging, LLP processes and then ships orders via your selected carrier Mon. – Fri. during normal business hours. Orders placed after 12 PM EST or on days w/ no pickup will begin fulfillment the next business day in the order in which they were received.
  • Standard shipping turnaround may not apply during holidays, office closures, and times of increased order volume and on orders containing items that require extended production time.
  • Shipping is exclusively to the 48 contiguous states within the U.S.
  • To cancel an order from our online store only before it is shipped, contact us at 248-943-6689 or email info@8ballimaging.com and the warehouse manager may cancel the order if the order is still in process. Note that refunds may take several days or more and are subject to the card holder’s bank policy and processing procedures. Please see REFUNDS AND RETURNS for more details.

B. Free Shipping:  when offered, will be on items deemed as promotional or specials defined by 8 Ball Imaging, LLP & any of its affiliates.

Orders & Purchases

A. Payment terms:  Unless paid in full upfront, a minimum 50% nonrefundable deposit is due to be paid & cleared before your order begins processing on custom orders. Payment constitutes approval of any artwork with no further modifications or add on. Once a deposit is received, a final invoice will be sent to you for the balance and date due if applicable (not paid in full upfront).  Items with outstanding balances beyond the final invoice date due will have 30 days to pay the balance or items will be forfeited and donated to a local charity or organization.
Items will not be released or shipped until total payment is received and cleared.

B. Add-Ons. The following guidelines are in effect to prevent processing errors and ensure all orders are processed accurately and on time.

  • Store Purchases: Items cannot be added to an order once the order is submitted, even if the order has yet to be shipped. Special requests by phone or email are not acceptable.
  • Two or more submitted orders cannot be combined while in the processing queue.
  • Custom Printing: Additional add on garments or accessories will void out any previous invoice sent & a new invoice that reflects a new price, quantity etc. will be sent as a replacement & final.

Refunds & Returns:

Cancellations

Custom Orders

You may cancel custom orders before they are processed & shipped within 24-hrs.  Once items have been processed &/or shipped, they cannot be cancelled. Any requests for a refund please see our refund & returns policy below. 

In the event that you cancel an order, the amount of the refund will be based on the status of the order in the queue. A restocking fee for the garments purchased or processed may be assessed. If your order is already processed & completed, even prior to shipping, no refund will be issued.

Store Purchases

You have a 24-hr window to cancel all store purchases before they are processed & shipped.  Once items have been processed & shipped, they cannot be cancelled. Any requests for a refund please see our refund & returns policy below. 

REFUND/Returns Policy

Custom Orders

At 8 Ball Imaging, LLP we stand behind our work & hope that you are 100% satisfied with your order. If there should be an error on our part, while we do not offer refunds on any order that has been processed & shipped, we will reprint the order to the correct specs if a mistake has been found. If upon receiving your order you find that something is incorrect, you must notify us within 72 hours of the delivery of your product. Once we are notified, we will do everything we can to take care of any issues in a timely manner. If it is determined that you need to return products to us for inspection or to be reprinted, the product must be returned within 1 business week of the stated claim. If you have contacted us to make a return and we have agreed to cover the shipping costs, all items must be shipped using ground ship methods from UPS or FedEx, any other methods of shipping (3-day ship, 2nd day air, next day air, next day saver) will not be covered. If items are returned after this timeframe, the shipment will be denied and the package will be sent back to you, unless prior arrangements have been made.

Store Purchases

Please Note You must contact us within 48-hrs of receipt of your order & speak to an 8 Ball representative before sending any items back.

We will honor returns under the following conditions:

  1. Wearable Items: Garments ordered & shipped per our error, (not the error of the customer ordering the wrong size, color or graphic choice) may be returned new, unused, unworn & in their original packaging within 7 business days of purchase. A store credit or full refund may apply. We will not accept nor refund any worn, washed, items, any items beyond 7 business days of purchase, without notification or if the item printed, produced & shipped was of the customers’ error when ordering.
  2. Non-Wearable Items: Any item that cannot be described as clothing i.e. Promotional Items, Glassware, Mugs, Totes etc. are non-wearable items. These items, usually printed in bulk, are non-refundable but can be exchanged or given a store credit if there is an error in the printing process. If any damages, please contact us 1st to submit a claim(see Damaged Items below.)  
  3. Damaged Items If a customer receives an order and one or more of the contents are damaged, as a result of 8 Ball Imaging & not the carrier, mail handler or shipment depot, the customer may either coordinate an exchange with 8 Ball for a replacement of the same item as the one that was damaged or return the item and receive a refund for the item. To submit a claim for a damaged item, customers must call us at 248-943-6689 or email at info@8ballimaging.com  with a description and photo evidence of the damage. Any damaged or defective items must be reported to us within 48- hours of receiving it.
  4. Exchanges We only replace items if they are defective. If you need to exchange it for the same item, send us an email at info@8ballimaging.com or call us at 248-943-6689

Shipping returns

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable (unless it is determined that 8 Ball Imaging is at fault, then we will cover shipping). If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

You may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.  We will notify you via email when your item has been received by 8 Ball Imaging

Late or missing refunds

Please note that credit card refunds may take longer than expected and are subject solely to the customer’s bank policy. Once a refund is issued, 8 Ball Imaging, LLP possesses no control over the speed or lack thereof with which funds are transferred and bears no responsibility for funds delayed or held by the customer’s bank.

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Other Non Returnable Items

Several types of goods are exempt from being returned.

Additional non-returnable items:

  • Gift cards
  • Downloadable software products
  • Some health and personal care items, if applicable

Sale items

Only regular priced items may be refunded. Sale items are final and cannot be refunded.

Custom Artwork Requests & Submission

**We reserve the right to request a right to use license or written consent, from the owner for artwork submitted by the customer for reproduction or refuse said artwork submitted that may impose copyright infringement.
Licenses, permissions or consents cannot be completed by phone.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with 8 Ball Imaging, LLP and its licensors.

Third Party Services

In using the Services, (uploading graphics) you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).
If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Accounts

Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.
You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.
You are responsible for maintaining the security of your account that you use to access the Service. You shall not share or misuse your access credentials. You must notify us immediately of any unauthorized uses of your account or upon becoming aware of any other breach of security, as we will do the same in the event of any known breaches or security risks become available.

Termination

We may terminate or suspend your access to all or any part of our online Services at any time, with or without cause, with or without notice, effective immediately.
If you wish to terminate the Agreement or your 8 Ball Imaging, LLP account, you may simply discontinue using our Services & your data will be erased immediately from all databases.
All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. 8 Ball Imaging, LLP and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither 8 Ball Imaging, LLP, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of United States.
The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in United States.

Changes

8 Ball Imaging, LLP reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.
If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.
Your continued use of our Services will be subject to the new terms.
